Terms of Service

1. Scope

These Terms of Service apply to the use of the online service FloBudget (flobudget.eu / flobudget.de), operated by Pascal Mielke (hereinafter "Provider").

2. Description of Services

FloBudget is a web-based software for personal finance management. The service is offered in two variants:

  • Free: Free of charge, with limited functionality.
  • Pro: Paid, with full functionality as per the current price list on flobudget.eu.
3. Contract Conclusion and Account

A usage contract is established upon registration. The user must be of legal age and may only operate one account. Login credentials must be kept confidential. Registration and login can be done either with email and password or optionally via a Google account (Google OAuth). When using Google OAuth, the Google Terms of Service also apply.

4. Payment (Pro Plan)

The Pro plan is billed monthly or annually in advance. Payment is processed via the payment service provider Stripe (Stripe Payments Europe, Ltd., Ireland). By taking out a subscription, the user accepts the Stripe Terms of Service.

Outside the statutory withdrawal period pursuant to § 11 – or after it has lapsed due to the user's express consent – payments made are generally non-refundable, unless the Provider failed to provide the service or the payment was collected due to a Provider error. The Provider reserves the right to adjust prices; existing subscribers will be informed of this by email at least 30 days in advance. Price adjustments apply exclusively to future billing periods and do not apply retroactively to current subscriptions.

5. Cancellation

The user may delete their account at any time via the settings. For paid plans, access to the Pro features ends at the end of the paid period. Fees already paid will not be refunded on a pro-rata basis unless required by law.

The Provider may block or delete accounts for good cause – in particular in the event of a breach of these Terms of Service – without prior notice, to the extent necessary to protect the service or other users.

6. User Obligations
  • No misuse (e.g. no automated mass retrieval, no circumvention of security mechanisms). Excessive or automated access may be restricted or blocked without prior notice.
  • No unlawful, offensive or objectionable content.
  • Do not share login credentials with third parties.
  • The user remains solely responsible for the accuracy and completeness of the financial data they enter. FloBudget merely provides the tool; no content review of the inputs is performed.
7. Availability and Data Backup

The Provider strives for high availability of the service but does not guarantee uninterrupted accessibility. There is no entitlement to a specific minimum availability. Planned maintenance work may lead to short-term restrictions and will be announced in advance where possible.

The user is responsible for regularly backing up their own data. FloBudget offers an export function (GDPR export) that the user can use for data backup. The Provider accepts no liability for loss of user data due to force majeure or user error.

8. Force Majeure

The Provider is not liable for service failures or impairments caused by events beyond its control. These include in particular power outages, data centre infrastructure failures, natural disasters, acts of war, government orders, and disruptions to the internet or other public communications networks. In such cases, the Provider is released from its performance obligations for the duration of the impairment.

9. Liability

The Provider is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In cases of simple negligence, the Provider is only liable for breaches of essential contractual obligations (cardinal obligations) and limited to the foreseeable, typical damage at the time of contract conclusion.

FloBudget does not replace professional financial or tax advice. No liability is accepted for the accuracy of data entered or for data loss due to force majeure or user error.

11. Changes to the Terms of Service

The Provider reserves the right to amend these Terms of Service with 30 days' notice by email, provided the amendment is reasonable for the user. If the user does not object within this period, the new Terms of Service shall be deemed accepted, provided the user continues to use the service after the period has expired. The right to object and the consequences thereof are expressly noted in the amendment notification.

12. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days from the date of contract conclusion. The full withdrawal policy and the model withdrawal form are available at flobudget.eu/widerruf.

The right of withdrawal may expire early if the statutory conditions are met, in particular if the user has expressly agreed that the Provider begins providing the service before the withdrawal period expires and the user has acknowledged that they will lose their right of withdrawal upon complete performance of the contract. When taking out a subscription, the user is informed accordingly prior to contract conclusion and asked for explicit confirmation.

13. Usage Rights

All rights to the FloBudget software remain with the Provider. For the duration of the contractual relationship, the user is granted a simple, non-exclusive and non-transferable right to use the service for its intended purpose. Reproduction, distribution or use beyond the contractually agreed scope is not permitted. Reverse engineering, decompilation and circumvention of technical protection measures are prohibited unless expressly permitted by mandatory law.

14. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually residing in the European Union, the mandatory consumer protection provisions of their country of residence remain unaffected – the choice of German law does not deprive them of this protection.

The place of jurisdiction for merchants and legal entities under public law is Gelsenkirchen, to the extent permitted by law.
